General Service Conditions is a public offer, where ordering and payment are the acceptance.

Provider agrees to render Internet-services and Client agrees to use it within the frameworks of the following terms:

1. Provider reserves the right to change the Conditions at any time with 3 days prior notice to the users publishing the changes on the web-server minivds.com.

2. Provider agrees to do everything in his power to provide hardware smooth operation and Client's round-the-clock access to the rendering services.

3. To protect Client's privacy Provider will not distribute Client's name or e-mail address or any other data to any third party except as required by Russian law.

4. Client covenants to make full payments by the due date for the services ordered.

5. Client can use the rendered services in his/her discretion for commercial or other activity not securing Provider's advance consent.

6. Client retain control and ownership of its domain name. Provider shall have no rights of ownership over the domain names lodged on its servers. Provider shall guarantee that no domain names will be transferred from Client to Provider.

7. In consideration of the availability, and your use, of Provider's services, Client agrees and undertake, while visiting the services, not to:

7.1. defame, abuse, stalk, harass, threaten or otherwise violate the legal rights of others, including without limitation, rights relating to privacy and publicity;

7.2. post, transmit, link to, or otherwise distribute any, defamatory, infringing, or indecent material or information;

7.3. post, transmit, link to, or otherwise distribute any information constituting or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the Service in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the Service or the Internet;

7.4. post, transmit, link to, or otherwise distribute any information or software which contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component;

7.5. upload, post, publish, transmit, reproduce, link to or otherwise distribute in any way, information, software or other material obtained through the Service or any derivative work thereof, which is protected by copyright, or any other intellectual property right, without obtaining written permission of the copyright owner or right holder;

7.6. disable external computer systems due to sending/forwarding of data streams and/or emails (spam/mail-bombing), send emails to third parties for the purpose of advertising provided that he/she cannot assume that the recipient has an interest therein (e. g. after request or prior business relation);

8. Any breach of Clause 7 shall be deemed a material breach of this contract and shall entitle the company to terminate the contract and immediately withdraw all Internet services without penalty or recompense to the Client irrelevant whether the client is aware of the content of any material so transmitted or not.

9. Provider maintains control and any ownership of any and all IP numbers and addresses that may be assigned to Client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.

10. Provider reserves the right to restrict the execution of Client's scripts overloading system and server.

11. Provider must perform scheduled maintenance to servers from time to time. Provider will attempt to perform all scheduled maintenance at times which will affect the fewest customers. If scheduled maintenance requires the service to be offline for more than 30 minutes we will post details of the scheduled maintenance to the Web Host System News at least 48 hours in advance of the maintenance, or notify via email.

12. Client agree that Provider may suspend or terminate the Services and/or your Account and/or terminate the Agreement at any time for non-payment (when due) of the Charges or any other sum due from you under the Agreement or any other agreement with us; All payments are due on time and in whole. If an account is not paid by the due date, the client will be issued an email or contacted by other means notifying of the oversight. If payment is not received within 14 days of account due date, then the clients account/web site will (upon our sole discretion) be deleted.

13. Provider shall not be responsible for losses to Client that were incurred due to his/her negligence or/and for the injuries to Client due to his/her fault or the fault of third persons to whom Pprovider is not related.

14. Provider shall not be held liable for any loss or damage caused by the use, misuse, unavailability or removal of services.
